Plan B Productions produces and promotes festivals, exhibitions, marketplaces, community celebrations, and other live events. These Terms are intended to create clear expectations for everyone who uses our websites, requests or purchases tickets, participates in a promotion, or attends one of our events.
Please read these Terms carefully. By accessing a covered website, submitting a form, requesting or purchasing a ticket, or attending a covered event, you agree to these Terms and any additional rules or disclosures presented for the particular transaction, promotion, or event.
1. Agreement to These Terms
These Terms of Use ("Terms") are a legal agreement between you and Plan B Productions ("Plan B Productions," "we," "our," or "us"). They govern your access to and use of websites, landing pages, online forms, ticketing pages, QR-code destinations, social media promotions, communications, and events operated, organized, promoted, sponsored, or managed by Plan B Productions.
If you do not agree to these Terms, do not use the covered digital properties or complete a ticket request, registration, or purchase through them.
Additional terms, rules, waivers, refund policies, venue rules, promotion rules, or third-party platform terms may apply to a specific event or transaction. If a specific written term conflicts with these general Terms, the more specific term controls for that event or transaction.
2. Scope and Eligibility
These Terms apply across the Plan B Productions family of events and services, including the California Olive Festival, Gamer Festival, Replay: Toy & Hobby Show, Great Reptile Shows, and other current or future Plan B Productions events, productions, promotions, websites, programs, and services.
Online ticketing, purchases, and registrations are intended for adults who are legally capable of entering into a binding agreement. A parent, legal guardian, or other authorized adult must complete transactions on behalf of a minor.
By using a covered service, you represent that the information you provide is accurate, that you are authorized to use the submitted contact and payment information, and that your use complies with applicable law.
3. Event Information and Availability
We make reasonable efforts to provide accurate event information. Dates, times, locations, entrances, parking arrangements, schedules, programming, attractions, demonstrations, exhibitors, vendors, speakers, entertainment, ticket availability, and other event details may change.
Photographs, maps, schedules, vendor lists, menus, demonstrations, and promotional descriptions are provided for general informational purposes and do not guarantee that a particular person, business, product, activity, or attraction will be present or available.
Event access and activities may be limited by venue capacity, safety requirements, weather, governmental direction, operational needs, or circumstances beyond our reasonable control.
4. Tickets and Registration
A ticket, registration, confirmation, barcode, QR code, wristband, credential, or other admission document is a revocable license to enter the applicable event, subject to these Terms, the event listing, venue rules, and lawful instructions from event personnel.
Tickets may be delivered electronically, displayed on a mobile device, printed, held at will call, or provided through another stated method. You are responsible for supplying accurate contact information and safeguarding admission credentials.
Tickets may not be duplicated, reproduced, altered, counterfeited, or used more than permitted. We may reject a ticket that is invalid, duplicated, transferred contrary to stated restrictions, obtained through fraud, or previously redeemed.
Unless expressly stated otherwise, a ticket admits only the number and category of guests identified in the order or registration. Age-based or eligibility-based ticket categories may require reasonable verification at entry.
5. Complimentary Tickets and Promotions
Complimentary tickets, promotional admissions, discount codes, giveaways, and similar offers may be subject to quantity limits, expiration dates, eligibility requirements, redemption instructions, capacity restrictions, and additional promotion rules.
Complimentary tickets have no cash value, may not be sold, and may not be exchanged for cash, credit, merchandise, or another event unless we expressly agree otherwise in writing.
A complimentary registration does not guarantee admission after stated redemption deadlines, during a capacity closure, or when the ticket was obtained or used contrary to the applicable offer.
We may cancel or invalidate promotional tickets issued because of fraud, automated submissions, duplicate claims beyond a stated limit, inaccurate information, abuse of an offer, or a technical or publishing error.
6. Pricing, Fees, and Payment
Prices and required charges will be presented during the applicable purchase process. Taxes, ticketing fees, payment processing charges, delivery charges, or other lawful charges may apply as disclosed before purchase.
Ticket sales may be processed by Eventbrite or another third-party ticketing or payment provider. The provider may apply its own terms, payment procedures, security measures, and service fees.
You authorize the applicable payment provider to charge the payment method you submit for the displayed total. We may cancel an order affected by suspected fraud, an unauthorized payment method, a pricing or inventory error, or a payment that is declined or reversed.
7. Refunds, Cancellations, and Event Changes
The refund policy displayed on the applicable event listing or during checkout governs the purchase. Unless a different policy is presented, ticket purchases are final and nonrefundable except when required by law or when Plan B Productions cancels the event without providing a replacement date or comparable admission option.
If an event is postponed, rescheduled, relocated, modified, or transferred to a replacement date, existing tickets may remain valid for the revised event. We will provide available instructions through the contact information associated with the order or through the applicable ticketing platform.
Changes to schedules, programming, vendors, exhibitors, attractions, performers, speakers, menus, activities, parking, or venue access do not by themselves entitle a ticket holder to a refund.
Third-party ticketing and payment fees may be subject to the applicable provider's refund rules. Refund requests must be submitted through the method identified in the event listing, order confirmation, or ticketing platform.
8. Admission and Event Conduct
Admission is subject to venue capacity, security screening, posted policies, and reasonable instructions from Plan B Productions, venue personnel, security, emergency responders, and governmental authorities.
Guests must behave safely and respectfully. Prohibited conduct includes violence, threats, harassment, discrimination, disorderly behavior, theft, fraud, intentional property damage, unsafe use of equipment, unauthorized sales or solicitation, interference with event operations, and violation of applicable law or posted event rules.
Weapons, illegal substances, hazardous materials, and other restricted items are prohibited to the extent stated by law, venue policy, or event rules. Service animals are permitted as required by applicable law. Other animals may be restricted.
We may refuse entry or remove a person who violates these Terms, creates a safety or operational concern, or fails to follow lawful instructions. Unless required by law, removal or refusal of admission for misconduct does not create a right to a refund.
9. Minors and Family Attendance
Children and minors must be supervised by a responsible adult as appropriate for their age and the event. A parent or guardian is responsible for deciding whether an event, activity, product, food item, demonstration, or environment is appropriate for a minor.
Age restrictions may apply to alcohol service, purchases, demonstrations, contests, or other activities. Government- issued identification may be required.
10. Health, Safety, and Assumption of Risk
Live events involve ordinary and foreseeable risks, including crowds, lines, uneven surfaces, temporary structures, weather, traffic, parking areas, food and beverage service, demonstrations, sound levels, interactions with other attendees, and exposure to communicable illness.
By attending, you voluntarily assume the ordinary risks associated with participation in a public live event, except to the extent a risk cannot lawfully be waived. You are responsible for exercising reasonable care, following safety instructions, monitoring children in your care, and considering your own health, allergies, mobility, and other personal circumstances.
Food, beverages, samples, and products may contain allergens or ingredients not identified by Plan B Productions. Ask the applicable vendor or provider about ingredients and preparation before consuming a product.
11. Photography, Video, and Publicity
Photography, video recording, livestreaming, and audio recording may occur at our events for security, documentation, news, advertising, archival, and promotional purposes.
By entering an event, you understand that you may appear incidentally in crowd, background, or atmosphere photography or recordings captured in public event areas. To the extent permitted by law, you grant Plan B Productions and its authorized partners permission to use such images and recordings without additional compensation.
We will seek additional permission when reasonably appropriate for a staged interview, testimonial, or featured individual portrait. A guest with a particular concern may contact event staff, although we cannot guarantee exclusion from all incidental crowd imagery.
Commercial photography, professional video production, media access, drones, livestreaming for commercial purposes, and use of specialized equipment may require advance written approval.
12. Vendors, Exhibitors, Sponsors, and Participants
Vendors, exhibitors, sponsors, volunteers, performers, presenters, demonstrators, and other event participants may be subject to a separate application, agreement, handbook, insurance requirement, permit, license, health rule, venue rule, or operational instruction.
Acceptance of an application or payment does not override a separate written participant agreement. In the event of a conflict, the specific participant agreement controls that participant's relationship with Plan B Productions.
Unless Plan B Productions is expressly identified as the seller, individual vendors are responsible for their own products, services, representations, warranties, licenses, permits, taxes, pricing, safety, and customer transactions.
13. Email, SMS, and Other Communications
We may send transactional or operational communications reasonably related to a ticket, registration, purchase, application, inquiry, or event participation.
Promotional email and SMS communications are governed by the consent and preferences presented when information is collected. Promotional emails ordinarily include an unsubscribe mechanism. SMS recipients may reply STOP to opt out.
Additional information appears in our Privacy Policy and SMS Terms and Conditions.
14. Acceptable Use of Our Digital Properties
You may use our digital properties only for lawful personal or business purposes consistent with their intended functions.
You may not:
- Attempt to gain unauthorized access to a website, account, server, database, or network
- Introduce malware, malicious code, or harmful automated traffic
- Scrape, harvest, or collect personal information contrary to law
- Interfere with website operation, security, or another person's use
- Submit false, misleading, fraudulent, or unauthorized information
- Claim tickets, enter promotions, or create registrations through bots or other unauthorized automation
- Impersonate Plan B Productions, an event, another person, or another business
- Use our content, names, or marks in a manner likely to cause confusion
- Violate applicable law or third-party rights
We may restrict or terminate access to protect our services, events, users, or legal rights.
15. Intellectual Property
Unless otherwise stated, the websites, designs, text, graphics, logos, event names, photographs, videos, layouts, downloads, promotional materials, and other content made available by Plan B Productions are owned by or licensed to Plan B Productions and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use our public digital content for personal, informational, and lawful ticketing or event-participation purposes.
You may not reproduce, republish, sell, license, modify, distribute, create derivative works from, or commercially use protected content without prior written permission, except as permitted by law.
Third-party names, trademarks, products, and content remain the property of their respective owners. Their appearance does not necessarily imply endorsement.
16. User Submissions and Feedback
When you submit an application, review, survey response, photograph, testimonial, suggestion, comment, contest entry, or other material, you represent that you have the right to submit it and that it does not violate law or another person's rights.
Unless a separate written agreement states otherwise, you grant Plan B Productions a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute the submitted material for the purpose for which it was provided and for related event, archival, operational, and promotional purposes.
You retain ownership of original material you submit. Do not submit confidential, proprietary, unlawful, infringing, or sensitive material unless specifically requested through an appropriate process.
17. Third-Party Websites, Platforms, and Services
Our websites, forms, advertisements, emails, and social media pages may link to or integrate services operated by third parties, including ticketing platforms, payment processors, form providers, venues, maps, social media platforms, vendors, sponsors, and tourism organizations.
Third-party services are governed by their own terms, policies, fees, availability, and security practices. Plan B Productions does not control and is not responsible for third-party content, systems, transactions, products, services, or privacy practices.
A link or reference does not necessarily constitute an endorsement. Use third-party services at your own discretion and review their applicable terms.
18. Disclaimers
To the fullest extent permitted by law, our websites, digital properties, information, promotions, and event-related materials are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.
We do not guarantee that a website will be uninterrupted, error-free, secure, or free from harmful components, or that all event information will remain unchanged.
We do not warrant or guarantee the quality, safety, legality, availability, or suitability of products or services offered by independent vendors, exhibitors, sponsors, venues, or other third parties.
Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.
19. Limitation of Liability
To the fullest extent permitted by law, Plan B Productions and its owners, officers, employees, contractors, agents, affiliates, event partners, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of a digital property, inability to access a service, attendance at an event, or conduct of a third party.
To the fullest extent permitted by law, the aggregate liability of Plan B Productions for a claim arising from a paid ticket or registration will not exceed the amount paid directly to Plan B Productions for the specific ticket or registration giving rise to the claim.
For a complimentary ticket, free service, or free promotion, aggregate liability will not exceed one hundred dollars ($100), to the fullest extent permitted by law.
These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or other conduct for which limitation is prohibited by applicable law.
20. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Plan B Productions and its owners, officers, employees, contractors, agents, affiliates, event partners, and representatives from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful conduct, your material breach of these Terms, your misuse of a covered service, or material you submit in violation of another person's rights.
This section does not require a consumer to indemnify Plan B Productions for Plan B Productions' own negligence, willful misconduct, or other responsibility that cannot lawfully be shifted.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply.
Before filing a formal claim, you and Plan B Productions agree to make a good-faith effort to resolve the matter informally. Send a written description of the issue and requested resolution to the contact information below.
Unless applicable law requires otherwise, any court proceeding arising from these Terms or a Plan B Productions event must be brought in a state or federal court with jurisdiction in San Joaquin County, California. Nothing in this section prevents an eligible party from using small claims court.
22. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any applicable event-specific, transaction-specific, promotion-specific, or participant terms, constitute the agreement governing the covered activity.
Severability
If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
No Waiver
A failure to enforce a provision does not waive the right to enforce it later.
Assignment
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, financing, transfer of an event or service, merger, or sale of business assets.
Headings
Section headings are provided for convenience and do not alter the meaning of these Terms.
23. Changes to These Terms
We may revise these Terms to reflect changes in our events, websites, technologies, service providers, business practices, or legal obligations.
When these Terms are updated, we will revise the “Last Updated” date shown at the top of the page. Changes become effective when posted unless a different effective date is stated.
Terms in effect when a transaction is completed will ordinarily govern that transaction, except where an update is required by law or applies to continuing use of a service.
